Summary
Aristoteles schildert uns den Areopag vor Solon und unter Solon mehrfach als die eigentlich massgebende behörde, aber in ziemlich allgemeinen wendungen, so dass wir zunächst nicht viel weiter zu kommen scheinen. die vormacht des Areopages, die er für die jahre 480–462 angibt, ist eine effective, nicht durch eine verfassungsänderung ihm neu verliehene. Ephialtes nimmt ihm diese macht durch bestimmte gesetze deren stelen die dreissig umreissen (35, 2): damals sind also ganz be stimmte competenzen dem Areopage entzogen. Aristoteles bezeichnet sie als ἐπιθετα in übereinstimmung mit der officiellen terminologie), im gegensatze zu den πατϱια, die dem rate blieben, d. h. dem blutgerichte. daraus ergibt sich zunächst ein vollkommener widerspruch. entweder Ephialtes hat dem Areopage nur ἐπιθετα genommen, dann gehöte was er ihm nahm nicht zu seinen ursprtinglichen rechten. er nahm ihm die eigentlich politische macht: also kann diese nicht ursprünglich gewesen sein, also kann der Areopag nicht ϕὑλαζ ϰαι ἐπισϰоππоς τησv πоλιτείας gewesen sein, wie doch cap. 3 u. s. w. steht. oder aber diese nachricht ist richtig, dann hat Ephialtes dem Areopag πάτϱιαund nicht ἐπίθετα genommen. von diesem widerspruche können wir den Aristoteles nicht befreien. aber wol können wir ihn als einen für die officielle geschichte Athens schlechthin unvermeidlichen erkennen. die partei des Ephialtes hat gesiegt, und sie hat selbstverständlich sich nicht selbst als revolutionär betrachtet, musste also was sie dem Areopag nahm als von rechtswegen diesem gar nicht zustehend bezeichnen, so dass sie nur einen übergriff beseitigt hätte.
