Cette période, qui commence au début de la seconde moitié du XIXe siècle, se caractérise par les débuts et le développement — qui s'accentuera par la suite, en grande mesure après la Deuxième Guerre mondiale — de la codification internationale du droit de la guerre: en conséquence, ce droit ne sera plus exclusivement coutumier comme jusqu'alors.
