Constitutionality of provision dispensing with father's consent to adoption of illegitimate child in South Africa

Published online by Cambridge University Press:  28 July 2009

Extract

Section 18(4) (d) of the Child Care Act, 1983, dispensed with the father's consent for the adoption of an illegitimate child. In this case the Children's Court had made an order sanctioning the adoption of a child and the applicant (the father of the child) sought a review of the decision on the ground that section 18(4) (d) was unconstitutional.
