3. We can see this in the theory of speech acts. This theory, developed by J L Austin, emerged from a series of seminars conducted by him and H L A Hart shortly after the war. It owes something to Hart who, on the basis of his pre-war practice as a lawyer, pointed to the analogy between ‘performative utterances’ and such formal legal acts as marriage and the making of wills.
