“Do Democracies Have Separation of Religion and State?”

Abstract. While many argue that separation of religion and state (SRAS) is an essential element of democracy, others posit that religion is an essential element of democracy's moral underpinnings. This study examines the debate using data from the Religion and State (RAS) dataset, which includes 62 variables in six broader categories measuring different aspects of SRAS for all 152 states with populations of one million or more, as well as data on democracy from the Polity and Freedom House datasets. It also develops seven operational definitions of SRAS that can be constructed using this data. Overall, the results show that a clear majority of democracies do not have SRAS even when evaluating multiple operational definitions of both democracy and SRAS. However, democracies tend to have lower average levels of government involvement in religion (GIR) than do non-democracies. This is because, while most democracies do not have SRAS, there is an upper limit to the amount of GIR that is found in any democracy that does not appear to apply to non-democracies. All this indicates that the proper question regarding religion and democracy is not one of SRAS but rather one of how much and what types of GIR can democracies tolerate.
Résumé. Alors que de nombreuses personnes prétendent que la séparation de la religion et de l'État est un élément essentiel de la démocratie, d'autres avancent que la religion est un élément essentiel des fondations morales de la démocratie. Cette étude analyse ce débat en utilisant des données provenant de la base de données Religion and State, qui comprend 62 variables regroupées en 6 grandes catégories et mesurant les différents aspects de la séparation de la religion et de l'État dans les 152 pays dont la population atteint un million d'habitants ou plus, ainsi que les données sur la démocratie fournies par la base de données Polity et l'indicateur de Freedom House. L'article met aussi au point sept définitions fonctionnelles de la séparation de la religion et de l'État, que l'on peut composer à partir de ces données. Dans l'ensemble, les résultats montrent que la grande majorité des démocraties ne pratiquent pas la séparation de la religion et de l'État, même lorsque l'on prend en compte plusieurs définitions fonctionnelles de la démocratie et de la séparation de la religion et de l'État. En revanche, le niveau moyen d'engagement religieux du gouvernement tend à être plus bas dans les démocraties que dans les pays qui ne sont pas des démocraties. Cela s'explique par le fait que, bien que la plupart des démocraties ne pratiquent pas la séparation de la religion et de l'État, elles observent un plafond d'engagement religieux qu'on ne retrouve pas dans les pays qui ne sont pas des démocraties. Tout ceci indique que la question la plus appropriée concernant la religion et la démocratie n'est pas celle de la séparation de la religion et de l'État, mais plutôt celle du degré et des modèles d'engagement religieux que les démocraties peuvent tolérer de la part de leurs gouvernements.
Numbers and Newness: The Descriptive and Substantive Representation of Women

Abstract. The concept of “critical mass,” drawn from physics and organizational behaviour literatures, has been employed by women and politics scholars as a potential theoretical underpinning for explaining and predicting women's substantive representation in national legislatures. This article examines two number-based theories of women's substantive representation—critical mass theory and sex-ratio proportional theory—and assesses their theoretical utility. It then proposes the alternative of focusing on the impact of newness, or a substantial increase in the number and proportion of women elected for the first time, on women's substantive representation. The article identifies research design issues and discusses the intersection of “newness” and “numbers” for evaluating women's substantive representation in parliaments. Offering a range of hypotheses for testing, it concludes by identifying an irony for critical mass research and by underscoring the necessarily gendered nature of the newness-numbers intersection.
Résumé. Le concept de “ masse critique ” issu de la physique et de la recherche en comportement organisationnel a été utilisé par les spécialistes du rapport femmes et politique comme modèle théorique possible pour expliquer et prédire la représentation substantive des femmes dans les législatures nationales. Cet article se propose d'examiner deux théories quantitatives de la représentation substantive des femmes et d'évaluer leur utilité théorique : 1. la théorie de la masse critique et 2. la théorie proportionnelle du sex ratio, et propose un autre modèle basé sur l'incidence de la nouveauté, ou une augmentation sensible dans le nombre et les proportions de femmes élues pour la première fois, sur la représentation substantive des femmes. L'article se penche sur les questions de méthodologie de la recherche et analyse l'intérêt du point d'intersection “ nouveauté ” et “ chiffres ” pour l'évaluation de la représentation substantive des femmes dans les parlements. À partir d'un choix d'hypothèses permettant d'évaluer ces modèles, l'article conclut en identifiant une ironie en ce qui concerne la recherche de masse critique et en soulignant le fait que la nature du point d'intersection nouveauté/chiffres est forcément marquée par le genre.
Authorizing Humanitarian Intervention: Hard Choices in Saving Strangers

Abstract. In recent years, the question of authorization for the use of force for humanitarian purposes has become more contentious than ever. Participants on both sides of the debate, namely those rejecting any exception to the requirement for UN authorization and the proponents of surpassing this in cases of exceptional humanitarian emergencies, do not seem to have reached any consensus. This article examines these opposing arguments, their legal interpretations, and tests the theoretical assumptions against state practice through a review of the record of humanitarian interventions since the 1990s. The final purpose is to assess two of the most promising alternatives for authorization: the UN and regional organizations. This analysis suggests some implications of the debate for the perception of the UN role in authorizing interventions, in addition to determining the need for alternative mechanisms to authorize interventions for humanitarian purposes.
Résumé. Dans les dernières années, la question de l'autorisation du recours à la force dans des missions à but humanitaire est devenu un sujet particulièrement contesté de l'actualité. Les participants aux deux côtés du débat, ceux qui rejettent toute exception à l'autorisation préalable des Nations Unies et ceux qui proposent de court-circuiter l'ONU dans des situations humanitaires d'une urgence exceptionnelle seulement, ne semblent pas pourvoir atteindre de consensus. Cet article examime ces deux vues opposées et leurs interprétations juridiques et met leurs hypothèses théoriques à l'épreuve de la pratique en considérant les missions humanitaires entreprises depuis 1990. Le but ultime consiste à évaluer deux des alternatives d'autorisation les plus prometteuses : celle des Nations Unies et celle d'organisations régionales. Cette analyse suggère certaines implications du débat quant à la perception du rôle des Nations Unies dans le processus d'autorisation des interventions et révèle, d'autre part, le besoin de mécanismes nouveaux pour autoriser ces missions humanitaires.

Résumé. Cet article porte sur l'utilisation du concept de “ liberté d'expression ” par une station de radio de Québec, CHOI-FM, dans ses démêlés avec le CRTC et dans le procès de Sophie Chiasson contre la station en Cour supérieure du Québec. Bien que les promoteurs de CHOI-FM aient fait de la liberté d'expression leur argument principal en 2004 et 2005, nous défendons l'hypothèse que cet argument était purement instrumental. Cependant, le concept de liberté d'expression mérite d'être analysé, car il a un pouvoir d'évocation peu commun en démocratie; il renvoie en effet à la nécessaire effervescence du débat public et à l'individualisme. D'autre part, la liberté d'expression a aussi été associée au populisme et au discours illicite, éléments auxquels elle confère un vernis de respectabilité.
Abstract. This paper deals with the use of the concept of freedom of expression by a Quebec City radio station, CHOI-FM, in its dispute with the CRTC and in the court case of Sophie Chiasson before the Quebec Cour supérieure. Although freedom of expression is the main argument used by CHOI-FM in 2004 and 2005, our hypothesis is that this argument is mainly instrumental. Nevertheless, freedom of expression must be analyzed because it is a major symbol of democracy; it is linked with lively public debate and individualism. In this case, freedom of expression is also used in an attempt to lend respectability to populism and illicit discourse.

Abstract. This paper takes the Prometheus story in chapter 12 of Leviathan as the point of entry for an examination of the importance that Hobbes assigns to the problem of an uncertain future in his political philosophy. Hobbes's thinking on human nature represents a dramatic departure from the ancients not only because his mechanistic psychology reverses the ancient conception of the relation between reason and passion but also because his understanding of the temporal situation of human beings privileges the future to an unprecedented degree. It is against the backdrop of a universe in which the problem of an uncertain future has reached intolerable proportions that Hobbes develops his portrait of human nature; it is against the backdrop of this universe that he develops his account of Leviathan as the only earthly power capable of stabilizing the horizon of expectation.
Résumé. Cet article utilise l'histoire de Prométhée au chapitre 12 du Léviathan comme introduction à l'examen de l'importance qu'accorde Hobbes au problème de l'incertitude de l'avenir dans sa philosophie politique. La pensée de Hobbes sur la nature humaine constitue une dérogation spectaculaire par rapport aux Anciens non seulement parce que sa psychologie mécaniste s'oppose diamétralement à l'ancienne conception de la relation entre raison et passion, mais également parce que sa compréhension de la situation temporelle des êtres humains privilégie l'avenir et ce, à un degré sans précédent. C'est sur la toile de fond d'un univers dans lequel le problème de l'incertitude de l'avenir a atteint des proportions intolérables que Hobbes construit son portrait de la nature humaine comme un tourbillon de passions incontrôlées; c'est sur la toile de fond de cet univers qu'il élabore son récit du Léviathan, seule force terrestre capable de stabiliser les attentes de l'avenir.
Canadian Mining Companies and Corporate Social Responsibility: Weighing the Impact of Global Norms

Abstract. This study analyzes the factors that led two Canadian mining companies, Noranda and Placer Dome, to adopt polices on corporate social responsibility (CSR). Although much has been written on CSR in the business and organization fields, there has been little scholarly treatment of the topic from a social sciences perspective. A common assumption is that companies are merely reacting to societal pressures from transnational non-governmental organizations. This study challenges that assumption, by weighing the impact of emerging global norms of CSR against influences internal to the companies themselves, and domestic influences operating in Canada. The research findings point to the decisive influence of internal company dynamics and the experience of operating mines in Canada. While emerging global CSR norms are important, their role is more complex than is often assumed, as mining companies have been proactive in their efforts to shape those norms.
Résumé. Cette étude analyse les facteurs qui ont amené deux sociétés minières canadiennes, Noranda et Placer Dome, à adopter des politiques concernant la responsabilité sociale de l'entreprise (RSE). La RSE a fait couler beaucoup d'encre dans le domaine des affaires et de l'organisation, mais peu de chercheurs s'y sont intéressés dans la perspective des sciences sociales. On part très souvent de l'hypothèse que les sociétés se contentent de réagir aux pressions sociales exercées par les organisations non-gouvernementales transnationales. Cette étude remet cette hypothèse en question en comparant l'impact des normes globales émergentes de la RSE aux influences internes aux sociétés elles-mêmes, et aux influences domestiques qui s'exercent au Canada. Les résultats révèlent l'influence décisive des dynamiques internes des sociétés et celle de l'expérience dérivée de l'exploitation des mines au Canada. Les normes globales émergentes en matière de RSE sont certes importantes, mais leur rôle est plus complexe qu'on ne l'admet souvent car les sociétés minières ont joué un rôle très actif dans leur élaboration.

Abstract. With a focus on NAFTA, we offer an alternative model of trade negotiations that explains why the dominant partner is able to force concessions only on some issues. Key to our model is the concept of scope. The environment side agreement excited wide swaths of society; thus, scope was high and international power asymmetries appear to explain the result. Power asymmetries seemed unimportant, however, when bargaining over issues that affected small portions of society, such as individual tariff levels. Finally, in issues of medium scope, such as the rules of origin for the textile industry, power asymmetries and elements of traditional bargaining models likely account for the negotiated outcomes.
Résumé. Ce texte explique pourquoi, au cours de la négociation d'une entente commerciale, le pays dominant n'a pas en général intérêt à imposer ses préférences aux pays partenaires. Le concept de “ scope ” (ou de portée) sert à distinguer entre les différents enjeux d'une négociation. La négociation du traité de l'ALENA sert ici de cadre pour l'application de notre proposition. Parce que d'importants secteurs de la société jugeaient prioritaires les enjeux soulevés par l'accord parallèle sur la coopération dans le domaine de l'environnement, l'issue des discussions a été imposée au plus haut niveau par les dirigeants américains. En revanche, les taux tarifaires appliqués aux différents produits ne concernent chacun que des groupes restreints. Sur ces enjeux, les rapports de puissance ne jouent pas. Enfin, ce n'est que sur les enjeux intermédiaires, tels que les règles d'origine pour l'industrie textile, que les processus familiers de négociations internationales rendent compte de la réalité de façon satisfaisante.
Explaining Aboriginal Treaty Negotiation Outcomes in Canada: The Cases of the Inuit and the Innu in Labrador

Abstract. In 1977, the Inuit and the Innu in Labrador each submitted statements of intent to begin treaty negotiations with the federal and provincial governments under the federal comprehensive land claims process. On 22 January 2005, the Inuit, the federal government, and the province of Newfoundland and Labrador signed the Labrador Inuit Land Claims Agreement. The Innu, on the other hand, are nowhere near to completing their agreement. This paper seeks to explain why the Inuit were able to complete their agreement, whereas the Innu were not. It challenges the conventional explanation that an economic development project is a necessary condition for completing a treaty by arguing that a number of internal and external factors need to be taken into account.
Résumé. En 1977, les Inuits ainsi que les Innus du Labrador ont respectivement annoncé leur intention de lancer des négociations en vue de conclure un traité avec les gouvernements fédéral et provincial en vertu du processus des recendications territoriales globales. Le 22 janvier 2005, les Inuits, le gouvernement fédéral et la province de Terre-Neuve-et-Labrador ont conclu l'Accord sur les revendications territoriales des Inuit du Labrador. Les Innus, de leur côté, sont encore loin d'une entente. Cet article cherche à expliquer pourquoi les Inuits ont pu signer un accord alors que les Innus n'y sont pas parvenus. L'article remet en question l'explication souvent avancée voulant qu'un projet de développement économique soit une condition nécessaire à l'achèvement d'une entente et soutient plutôt qu'un ensemble de facteurs intérieurs et extérieurs doivent être pris en compte.
Voluntary Association Activity in Quebec and English Canada: Assessing the Effects of Region and Language

Abstract. This paper presents the first multivariate analysis of the combined effects of region and language on voluntary association membership in Canada. National survey data from 2000 indicate that Quebecers have the lowest average number of memberships, with Western Canadians highest and Atlantic and Ontario residents in between. Preliminary results also confirm that francophones report fewer memberships than anglophones. Findings from Poisson regression models, however, indicate a significant interaction between region and language: francophones have lower membership levels only in Quebec, and in Western Canada have higher levels than anglophones or allophones. These results hold even with controls for a number of possible explanatory factors suggested in the literature, including religious and socioeconomic differences across the regions and language groups. The implications for understanding patterns of voluntary association activity in Canada are discussed.
Résumé. Cet article présente la première analyse multivariable des effets combinés de la région et de la langue sur l'adhésion d'aux associations volontaires au Canada. Les données nationales de 2000 indiquent que les Québécois ont le plus bas nombre moyen d'adhésions, avec les Canadiens de l'Ouest plus hauts et des résidants de la région atlantique et de l'Ontario entre les deux. Les résultats préliminaires confirment que les francophones ont moins d'adhésions que les anglophones. Les résultats indiquent une interaction significative entre la région et la langue: les francophones ont moins d'adhésion seulement au Québec; dans le Canada de l'Ouest les francophones ont plus d'adhésion que les anglophones et les allophones. Ces résultats se tiennent même avec contrôle d'un certain nombre de facteurs explicatifs possibles suggérés dans la littérature, y compris des différences religieuses et socio-économiques à travers les régions et les groupes linguistic. Nous discutons les implications quant aux modèles d'association volontaire au Canada.

Young Trudeau: Son of Quebec, Father of Canada, 1919–1944, Max and Monique Nemni, translated by William Johnson, Toronto: McClelland & Stewart, 2006, pp. 352.
The authors of the present work, the first in a projected three-volume biography of Pierre Elliott Trudeau, have done Canadians a lasting service in publishing a meticulously researched account that shatters a number of longstanding myths surrounding the late prime minister's early years. Max and Monique Nemni are retired academics who were friends and admirers of Trudeau. When in his final years they approached him about writing a biography, he offered his full co-operation, including unprecedented access to his personal papers dating back to childhood.

The Politics of Electoral Systems is the most recent and thorough work currently available on electoral systems. There is, of course, The Handbook of Electoral Choice (Josep M. Colomer, ed., London and New York: Palgrave Macmillan, 2004) but this work focuses more specifically on the issue of electoral reform in relation to democratization. The Politics of Electoral Systems covers a wide variety of electoral systems from theoretical and empirical perspectives—and it does so excellently. This brand new work is destined to become no less than the bible of electoral systems.

Si le candidat d'extrême-droite Jean-Marie Le Pen a pu participer au deuxième tour de l'élection présidentielle d'avril 2002, c'est entre autres, assez paradoxalement, parce que des candidats d'extrême-gauche avaient grugé suffisamment de voix au candidat socialiste Lionel Jospin pour l'empêcher d'aller au-delà du premier tour. Comparée aux autres démocraties libérales, la France aurait donc un profil atypique, non pas du fait de la force, chez elle, de l'extrême-droite (celle-ci est aussi très présente dans beaucoup d'autres pays européens), mais plutôt du fait de la présence d'une “ gauche de la gauche ” qui recueille un nombre significatif de voix et a un poids certain dans la vie politique du pays.

This important volume recounts a meeting of some the best minds in political science, but, in the end, it is a meeting in the physical sense (as the volume comes out of a conference held at Yale in 2002) and not really in any intellectual sense. The ostensible goal of the volume is to proffer answers to what the editors call “a fundamental question about the proper place of problems and methods in the study of politics…. Which should political scientists chose first, a problem or a method?” (1). Unfortunately, a good many of the contributors to the volume ask whether this is a question at all. Perhaps unsurprisingly, most of those who reject the question do not have objections to the increased technical and mathematical nature of modern political science. And, equally unsurprising, those who suggest that method has too often come before problem are those who have earlier, and often eloquently, bemoaned the rise of rational choice theory and econometric applications. As an intellectual rapprochement, the work fails. It rather resembles a dinner of extended family, where long-held differences and grievances are kept just under the breath, but as a collection of essays by leading scholars which consider the methodologies and epistemologies of political science, the volume is a smashing success.

Le constat d'une fracture du rapport entre l'électorat et les grands partis politiques n'est plus à faire. Des analyses sociopolitiques calculent les taux d'abstention au vote et les expliquent par les désarticulations entre les aspirations des électeurs/électrices et les politiques d'orientation néolibérale adoptées récemment par les partis au pouvoir (Sommier, Le renouveau des mouvements contestataires à l'heure de la mondialisation, 2003). On parle de “ désenchantement ” démocratique (Perrineau, Le désenchantement démocratique, 2003). Ce contexte incite d'aucuns à parler de “ dépolitisation ” d'un électorat qui se tournerait vers les mouvements sociaux afin de trouver une issue à ce marasme. Est-ce la fin de la politique traditionnelle ou un nouveau départ?

Is everything old new again? Gerald Baier's insightful book brings back into the mainstream a long neglected examination of federalism from the perspective of judicial review. His analysis of the courts' impact on the development of federalism involves a detailed study of division of powers jurisprudence in the United States, Australia, and Canada. In each of these countries, Baier argues, the decisions of the highest courts continue to affect the shape of federalism, but his central claim turns on how these decisions are made. For Baier, judicial doctrine plays a significant role in influencing the reasoning of the courts and must be considered an independent variable worthy of study in its own right. Many scholars have debated the significance of doctrine on judicial decision making. However, Baier takes issue with scholars who, on the one hand, have characterized doctrine as a tool of objectivity and certainty, and those, on the other hand, who view doctrine as entirely political in nature (27). For Baier, doctrine is neither of these but it is “distinctly legal in character” and it is this legal reasoning that shapes outcomes (27).

This book is another welcome addition to the Canadian Democratic Audit Series. It sets out to assess the democratic credentials of Canada's judiciary—a most significant branch of government in post-1982 Canada. The book's approach is refreshing in several respects. Instead of the traditional focus on the well-rehearsed debate over the questionable democratic credentials of judicial review, the book attempts to evaluate the adequacy of the Canadian court system in relation to three basic tenets of democracy: participation, inclusiveness, and responsiveness. Unlike most accounts of Canadian political institutions, it pays due attention to elements of the court system beyond the Supreme Court of Canada. In so doing, Greene is able to assess more accurately whether the Canadian judiciary as a whole is living up to that set of reasonable democratic expectations.

The phenomenon of open source software produced by distributed networks of largely volunteer computer programmers has been studied by legal scholars, economists, sociologists, anthropologists and computer scientists but has to date not drawn significant attention from political scientists. Steven Weber's book undertakes a political economic analysis of this topic. Weber attempts to address the questions of what incentives establish and sustain co-operation in the absence of direct monetary rewards and how a system of governance develops despite the lack of conventional exclusionary property rights.

James Ceaser gave the first Tocqueville Memorial Lecture on American Politics sponsored by the Center for American Political Studies at Harvard in 2004. This volume contains an expanded version of his lecture, the three responses by, respectively, a historian, a political theorist, and a political scientist, and Ceaser's rejoinder or, in the case of Rosenblum, rebuttal to each. There are two things going on in this volume: a scholarly debate on how to approach the elusive question of the role of ideas in politics and a rather acrimonious argument over Ceaser's motivation.

The US Senate presents observers with a paradox. It is a strong and influential legislative chamber, whose strength and influence derive in great part from unique rules and norms that not only allow but genuinely celebrate obstructionism, and techniques that encourage the frustration of the democratic majority by unrestricted parliamentary gamesmanship. The filibuster—a tactic whose purpose is to prevent the accomplishment of legislative business—is a fundamental, defining characteristic of both Senate procedure and the Senate's institutional self-image. How does the Senate—with its jealously guarded traditions of unlimited debate, universal recognition, and disregard for germaneness—ever manage to get anything done?
