Summary
This chapter seeks to examine the notion of the ‘digital divide’ and its relationship with competition law and intellectual property (IP) policy. The ‘domestic’ digital divide refers to the differences between those who have access to Information Communication Technologies (ICTs) within a nation state, so that a developed country with good levels of access overall may experience major differences in access due to limitations on universal service and universal access, geography and differing levels of poverty. The international digital divide refers to the same difference but between nation states. This chapter considers how the interaction of competition and IP – the regulatory mechanisms that form the focus of this volume – can help to bridge the international digital divide (IDD).
