Clearly an international court is not so limited. In the Tinoco Arbitration (Great Britain v. Costa Rica), 18 A.J.I.L. 147 (1924), the arbitrator (Chief Justice Taft), while holding Costa Rica generally bound by the acts of the de facto Tinoco government, held it was not responsible when these acts violated the Costa Rican Constitution in force during the Tinoco regime.
