The Protocol for the Protection of the Mediterranean Sea against Pollution Resulting from Exploration and Exploitation of the Continental Shelf and the Seabed and its Subsoil aims at preventing, abating, combating and controlling pollution resulting from activities concerning the exploration and/or exploitation of the resources in the Mediterranean Sea Area by ensuring, inter alia, that the best available techniques, environmentally effective and economically appropriate, are used for this purpose (Article 3). For this purpose, the Protocol requires that all activities in the Protocol Area shall be subject to the prior written authorisation for the exploration and exploitation from the competent authority. Before granting an authorisation, the competent authority shall be satisfied that the installation complies with international standards and practice (Article 4). Parties shall prescribe that applications for authorisation, or application for renewals of an authorisation, are subject to submission by the candidate operator of a request to the competent authority. The application must contain, inter alia, a survey concerning the effects of the proposed activity; the precise definition of the area involved; particulars of the professional qualifications of the candidate; safety measures; a contingency plan; monitoring procedures; plans for removal of installations; precautions for specially protected areas; insurance to cover liability (Article 5).
The competent authority shall grant the authorisation only after examination of the requirements listed in Article 5 and in Annex IV. The authorisation shall specify the activities and the period of validity and may impose conditions (Article 6).
