  • International case-studies on regulation and science collaboration show how competition and economic pressures on the national regulators of biomedicine condition the development of jurisdictive regulations. But regulation that fails to guarantee a jurisdiction's optimal protection of patients and scientific research in favour of other interests commits foreseeable and avoidable “regulatory violence”. Even when well-intended, regulation gets caught up in the intense international competition to support public health and generate national wealth, with real-world implications. Evidence from Asia, Europe and the USA challenges the belief that regulation improves ethical practices in regenerative medicine, connects practitioners with good science, and protects patient safety.   • Over the last half century, courts have come to play increasingly important roles in democracies. That role is studied by historians, political scientists, constitutional lawyers and political theorists, but it is also important to all who are concerned about the practice and future of democracy. This book explores why it is that courts are playing this expanded role, as well as exploring two of the most distinctive features of the role of courts: their relationship with the executive arm of government and the role of courts in protecting fundamental rights. The book argues that the role played by courts in modern democracies varies across time and place and depends on a range of factors including constitutional text, constitutional history, and legal and political culture. This book draws on Justice O'Regan's experience as one of the first judges on South Africa's Constitutional Court, which was established shortly after the transition to democracy in 1994.

  • In the philosophy of law there has been a proliferation of advanced work in the last thirty years on the normativity of law. Recent theories explore law's character as a special kind of convention, shared cooperative activity, and social artifact, among other perspectives, to explain the precise way in which law provides subjects with reasons for action. Yet, for all their sophistication, such accounts fail to deliver on their promise, which is to establish how law creates more than just legal reasons for action. This Element aims to survey these views and others, situate them in a broader context of theories about the nature of law, and subsequently suggest a path forward based on the methodological continuity between analytical, evaluative, and empirical approaches to law's normativity.

  • This Element examines the notion of content-independence and its relevance for understanding various aspects of the character of law. Its task should be understood expansively, as encompassing both inquiry into that which makes law into what it is, and inquiry into what law ought to be, which values it ought to serve, and which aspects of its character may play a facilitative role in law realising aspects of its potential. Many existing discussions of content-independence focus largely on the justificatory aspects of content-independence: whether, and, if so, how, there can be content-independent reasons for action, or content-independent justifications of rules, or the extent to which political obligation is content-independent. This Element, too, examines such issues but also seeks to explore an additional possibility: that the notion of content-independence can illuminate issues regarding law's existence, identification, and systematicity.

  • We live in an age of sanctions. For geopolitical reasons, powerful states and economic blocks increasingly impose unilateral measures restricting economic transactions with certain target states. These sanctions may apply to transactions between the sanctioning state and a target country but may at times also extend to transactions between third states and the target state. By imposing such 'secondary' sanctions, states aim to further isolate the target state. The extraterritorial character of secondary sanctions makes them controversial, as they impinge on third states' economic sovereignty and the latter's operators' freedom to conduct international business. This book addresses the legality of secondary sanctions from multiple legal perspectives, such as general international law, international economic law, and private law. It examines how third states and operators can legally react against secondary sanctions, e.g. via blocking legislation or litigation. It also provides economic and political perspectives on secondary sanctions.

  • This Element is an interdisciplinary analysis of the language evidence produced before, during and following a lone-actor terrorism attack in Halle, Germany, on October 9, 2019, resulting in two casualties. During his final preparations, the perpetrator, twenty-seven-year-old Stephan Balliet, announced his attack online and disseminated a targeted violence manifesto shortly before live-streaming his violent act. This post-hoc investigation introduces a multi-method approach that synchronizes well-established qualitative methodologies for forensic text analysis – genre, text linguistics, appraisal and uptake – to elucidate these data types. Furthermore, a retroactive threat assessment based on language data from the trial transcripts provides a holistic review of the assailant's background, red flags, triggering events and warning behaviors that could have signaled his movements along the pathway to violence. The results are considered in an organizational context to highlight current challenges faced by security agencies when mitigating the risk of lone-actors who radicalize in online environments.
