The inter–institutional dynamics between courts and elected governments under the Canadian Charter of Rights and Freedoms have recently, and widely, been characterized as a "dialogue" over constitutional meaning. This article seeks to expand the systematic analysis of "dialogue" to lower courts of appeal, using Canadian federal government responses as a case study. In the process, the article clarifies the hotly debated operational definition of this metaphor, and develops two methodological innovations to provide a comprehensive measure of dialogue. The article's findings suggest that there is more dialogue with lower courts than with the Supreme Court of Canada. However, the evidence indicates that dialogue in the form of government appeals to higher courts–which explicitly signal the government's disagreement with the lower court–is as prevalent as legislative sequels, and the dominant form following judicial amendment.

In recent decades, the field of comparative politics generally has retreated from grand explanatory models and narrowed its scope and research ambitions (Katznelson, 1997; Lichbach, 1997). This is particularly evident in the structural–historical approach as well as in the increasingly influential rational choice and postmodern approaches to comparative research (Kohli et al., 1995: 2; Lijphart, 1970: 682–93; Skocpol and Summers, 1980: 174–97). The 1995 World Politics Symposium, at which leading comparativists gathered to discuss “The Role of Theory in Comparative Politics” was clear evidence of this trend. Many analysts deemed the construction of theory, or the “messy centre” in comparative politics, problematic and some realized the attractiveness of alternative approaches (Kohli et al., 1995). As Katznelson noted of recent comparative scholarship, “compared to the work of their predecessors… scholars in comparative politics have shortened their time horizons, contracted their regime questions, and narrowed the range of considered outcomes” (Katznelson, 1997).

Abstract. I argue in this paper that there are certain similarities between Catharine MacKinnon, on the one hand, and Mary Wollstonecraft and Jean Jacques Rousseau, on the other, in the conception of inequality and its origins. All three make two important claims that characterize their accounts of inequality: first, that inequality is not natural, and second, that the differences which are alleged to justify inequality are in fact produced by the inequality. These two claims distinguish one way of arguing for equality. I contrast this with another way of arguing for equality, one which acknowledges natural differences.

Résumé. Dans ce texte, je soutiens qu'il y a des similarités entre les conceptions de l'inégalité et de ses origines de Catharine MacKinnon d'une part et de Rousseau et Wollstonecraft d'autre part. Tous trois soutiennent deux thèses importantes qui caractérisent leur conception de l'inégalité : premièrement, l'inégalité n'est pas naturelle; deuxièmement, les différences qui sont invoquées pour justifier l'inégalité sont en fait le produit de cette inégalité. Ces deux positions sont distinctives d'une ligne d'argumentation défendant l'égalité. Je contraste cette ligne d'argumentation avec une seconde façon de défendre l'égalité qui diffère de la première en ce qu'elle reconnaît les différences naturelles.

Abstract. This study examines the consistency between public opinion and public policy during the period 1994–2001 by matching responses to national survey questions on 230 issues with enacted policy proposals on the same issues. Policy outcomes were consistent with majority opinion 49 per cent of the time. This represents a significant drop from 69 per cent during the Mulroney years (1985–1993). Low opinion-policy consistency since 1994 is primarily attributable to divergences between public majorities that are increasingly supportive of a change toward the right and the policies of Jean Chrétien that are more leftist and status quo oriented than those of his predecessor. We argue that these divergences go largely unnoticed by the public because they tend to occur on low-profile issues. On the other hand, the evidence suggests a much tighter correlation between opinion and policy on a small number of high-profile issues of which the public is much more aware, thereby creating the appearance of attentiveness to Canadian public opinion.

En comparant les décisions sur 230 enjeux de politiques publiques avec les résultats de sondages nationaux sur ces mêmes enjeux, cet article cherche à quantifier le degré d'adéquation entre l'opinion publique et la politique gouvernementale entre 1994 et 2001. Les calculs révèlent que seulement 49 pour cent des décisions du gouvernement de Jean Chrétien sont allées dans le même sens que l'opinion publique, en nette diminution par rapport aux 69 pour cent observés pendant la période Mulroney (1985–1993). La baisse de corrélation depuis 1994 est principalement attribuable à la divergence entre une opinion publique de plus en plus favorable au changement et idéologiquement orientée à droite et la politique du gouvernement de Jean Chrétien sensiblement plus résistante au changement et idéologiquement plus à gauche que celle de son prédécesseur. Le public a tendance à ignorer le manque de corrélation entre l'opinion et les politiques gouvernementales parce que les enjeux en question sont relativement peu importants. Par contre, il semble que la corrélation entre l'opinion et les politiques soit beaucoup plus forte dans un petit nombre d'enjeux importants que le public reconnaît, créant ainsi l'apparence d'un gouvernement attentif aux souhaits de l'opinion publique canadienne.

Résumé. L'auteur entend défendre dans cet essai une conception de la sécession qu'il appelle délibérative et la justifier par rapport à d'autres théories concurrentes de la sécession. En l'absence d'un encadrement juridique clair et rigoureux des cas de sécession, de plus en plus nombreux, qui échappent aux situations de domination coloniale prévues par le droit international, la question se pose en effet de savoir s'il n'existe pas d'autres moyens de les résoudre dans des conditions pacifiques. L'auteur soutient que la démocratie délibérative pourrait offrir de tels moyens. Le but de l'article est d'examiner dans quelles conditions et à l'intérieur de quelles limites.

Abstract. In this article, the author aims at supporting a deliberative conception of secession and at justifying it against other rival theories. In the absence of clear and rigorous legal regulations of more and more numerous cases of secession going beyond the situations of colonial domination already covered by the international law, the question arises as to whether other means for their pacific solution are available. The author contends that deliberative democracy could provide such a means and examines in what conditions and within what limits this could be achieved.

Abstract. Work exploring the relationship between public opinion and public policy over time has largely been restricted to the US. However, a wider application of this line of research can provide valuable insights into whether and how representation varies across political systems. This paper takes a step in this direction using a new body of data on public opinion and government spending in Canada. Analyses reveal that the Canadian public notices and responds (thermostatically) to changes in public spending in particular domains, and also that Canadian policymakers represent these public preferences in spending. The extent and nature of public responsiveness and policy representation varies across domains. Relationships are more pronounced in certain domains, and they are more ‘specific’ in some domains and more ‘global’ in others. The findings generally accord with the results of similar work in the US and the UK, although the details differ in important ways. Indeed, the differences are strongly suggestive about the structuring role of institutions.

Résumé. Les travaux portant sur la relation entre l'opinion publique et les politiques publiques se sont longtemps limités surtout aux États-Unis. Cependant, l'élargissement de cette piste de recherche peut fournir de précieuses connaissances sur les variations de la représentation au sein des systèmes politiques. Cette étude s'oriente dans cette direction en utilisant un nouveau corpus de données sur l'opinion publique et les dépenses du gouvernement au Canada. Les analyses révèlent que, dans certains domaines, la population canadienne observe les changements liés aux dépenses publiques et y réagit (de façon thermostatique) et que les décisionnaires canadiens traduisent les préférences de la population dans les dépenses. La portée et la nature de la réceptivité de la population ainsi que la représentation des politiques varient d'un domaine à l'autre. Les connexions sont plus étroites dans certains domaines, plus “ spécifiques ” dans d'autres et enfin, plus “ globales ” dans d'autres encore. En général, les résultats sont en accord avec ceux des travaux similaires menés aux États-Unis et au Royaume-Uni, malgré des différences importantes sur certains points de détail. En fait, les différences sont très évocatrices du rôle structurant des institutions.

This paper investigates the relationship between diffuse support for the Canadian Supreme Court (general, lasting attachments to the institution) and specific support (attitudes toward its policy outputs). We hypothesize that diffuse support for the Court will not be closely related to specific support until after 1988, when the Court began making a number of controversial decisions. Using data from 1987 and 1997 we test multivariate models of the determinants of diffuse support and discover that it is indeed correlated more with democratic norms than with attitudes toward specific policies in 1987, while the reverse is true in 1997. The fact that support for the Court now appears to be more closely tied to its outputs could have important political implications for the Court and its decisions.

L'étude des idées politiques est, malgré l'apparente floraison des approches, d'une homogénéité étonnante. La raison m'en semble être l'incapacité générale des formes de pensée dominantes de dépasser la distinction théorique entre le monde-langage et le “monde-monde”. Que l'on se tourne vers l'exégèse développée par Leo Strauss, vers les différentes versions contemporaines du matérialisme et de la sociocritique, ou vers les théories de moyenne portée à la Quentin Skinner ou à la Pierre Bourdieu, une constante se révèle: les “idées” et la “réalité” sont deux choses bien distinctes, et nul n'oserait se pencher sur les phénomènes de la vie politique sans l'arme cognitive que constitue cette distinction. L'incapacité théorique de dépasser cette dernière, telle est l'intuition à la base de ce texte, est liée à une méconnaissance des idées politiques comme phénomène humain. Avant de donner le détail de cette intuition et d'indiquer le plan de son exploration théorique, il faut définir les notions qui seront ici mises en oeuvre.

Abstract. In the age of the Charter, courts are an important part of the policy process, and judicial independence is the concept that structures the interactions between courts and other institutions. Historically, judicial independence in Canada was modelled on (and little different from) that of England; but politically-led reforms in the 1970s, and a string of more than a dozen Supreme Court decisions centred on the 1997 Remuneration Reference, are transforming the concept. At the same time, a parallel string of cases extends more limited but essentially similar guarantees to some other administrative bodies. Together, these developments represent an important and enduring change in the Canadian political landscape.

À l'ère de la Charte, les tribunaux sont un élément important de l'élaboration des politiques publiques, et l'indépendance judiciaire est le fondement des interactions entre les tribunaux et les autres institutions. Par le passé, l'indépendance judiciaire au Canada épousait le modèle britannique (et s'en éloignait assez peu); cependant, des réformes politiquement inspirées dans les années 1970 et une série de plus d'une douzaine de jugements de la Cour suprême centrés sur le renvoi de 1997 relatif à la rémunération sont en train de transformer ce concept. En même temps, une série de cas parallèles accorde des garanties plus limitées mais très similaires à d'autres corps administratifs. Ces changements se conjuguent pour modifier considérablement et de façon permanente le paysage politique canadien.

At the time of the decision to negotiate the North American Free Trade Agreement (NAFTA), advocates argued that closer integration with Canada and the United States would have a democratizing influence on Mexico's political regime (Baer and Weintraub, 1994: 174–79; Pastor, 1993: 67). Critics of the deal suggested just the opposite, insisting that NAFTA might perpetuate or even reinvigorate authoritarian rule (Aguilar Zinser, 1993: 203–15; Castañeda 1996). With the breakthrough elections of July 2000 and the transfer of executive power to an opposition party the — PAN, or National Action Party — it is timely to ask: were the advocates of NAFTA right all along? Was NAFTA the impetus for Mexico's long overdue transition to democracy?

This paper reports the results of a content analysis of election–related headlines in Canada's two English–language national newspapers, The Globe and Mail and The National Post, over the course of the 36–day 2000 federal election campaign. We found that the two national newspapers' headlines revealed differences in issue emphasis, leader portrayals and party assessment. Yet both newspapers embraced a game frame for election coverage–by focusing on the horse–race, leader personalities and campaign strategies–to the neglect of campaign issues and ideological distinctions between parties. These findings suggest that media game framing can result in troublesome consequences for constructive citizen engagement in election activities.

Outre le fait d'avoir défini une nouvelle mission pour le ministère des Affaires culturelles et modifié ses responsabilités, cette politique constitue un changement majeur dans les orientations gouvernementales, notamment par la création du Conseil des arts et des lettres du Québec et par la mise en place de nouveaux partenariats avec des ministères et sociétés d'État ainsi qu'avec le monde municipal. Un des objectifs de cette étude est de démontrer l'originalité de l'Advocacy Coalition Framework (ACF) pour l'analyse des politiques culturelles. Développé par Paul A. Sabatier et Hank Jenkins-Smith, l'ACF se concentre particulièrement sur le processus résultant du changement dans les croyances et les actions des acteurs impliqués.

Abstract. This article concerns the Politique culturelle du Québec which was adopted in 1992. Besides having outlined a new mission for the Ministry of Cultural Affairs of Quebec, this policy constitutes a major change in governmental orientation, notably through the creation of the Conseil des arts et des lettres du Québec (Provincial Arts Council) and through the establishment of new partnerships with other ministries, public corporations and municipal authorities. One of the objectives of this study is to demonstrate the originality of the Advocacy Coalition Framework (ACF) in the analysis of cultural policies. Developed by Paul A. Sabatier and Hank Jenkins-Smith, the ACF focuses primarily on the process resulting from changes in the beliefs and actions of the actors involved.

Abstract. This paper argues that Foucault's proposed positive program of practical critique in his later work, which he calls ‘critical ontology,’ provides a response to his critics. The goal of critical ontology is to “separate out, from the contingency that has made us what we are, the possibility of no longer being, doing or thinking what we are, do, or think.” However, it may be objected that, since Foucault emphasizes going beyond contingencies, it appears that he is guilty of committing a kind of genetic fallacy. I will defend Foucault against such a charge by using concepts and practices in child development as an illustration. The example of child development is fitting for political theorizing because the development model of childhood is now central to the practices and policies of healthcare providers, social workers and educators. Such practices and policies aim to enhance the abilities of individuals to be both citizens and autonomous agents. Yet the effects of these policies on individuals are not always positive. The paper concludes with a discussion of the implications of critical ontology for practices grounded in the model of child development.

Cet article cherche à démontrer que le programme positif de critique pratique que Foucault propose dans ses derniers ouvrages, et qu'il qualifie d'une “ontologie critique,” constitue une réponse à ses détracteurs. Le but de cette ontologie critique est de dégager “de la contingence qui nous a fait être ce que nous sommes la possibilité de ne plus être, faire ou penser ce que nous sommes, faisons ou pensons”. Néanmoins, il est possible d'objecter que Foucault commet une sorte d'erreur génétique, puisqu'il insiste sur la nécessité de dépasser les contingences. Je cherche à defendre Foucault contre cette accusation en utilisant les concepts et pratiques du développement des enfants comme illustration. L'exemple du développement des enfants convient à la théorie politique puisque le modèle d'aménagement de l'enfance est maintenant au coeur des pratiques et des politiques de ceux qui travaillent dans les secteurs de la santé, de l'aide social, et de l'éducation. Telles pratiques et politiques ont comme but d'accroître la capacité des individus d'agir en même temps comme citoyens et des êtres autonomes. Pourtant, les effets de ces politiques sur des individus ne sont pas toujours bénéfiques. L'article se conclut par une analyse des implications d'une ontologie critique pour des pratiques fondées sur le modèle du développement des enfants.

Abstract. This study proposes a new test of Maurice Pinard's theory on the rise of third parties applied to the case of the 1993 Canadian federal election. We assess the effect at the individual level of Pinard's factors (one-party dominance and grievances) on support for the Reform party and the Bloc Québécois using data from the Canadian Election Study. Logistic regression analyses of vote choice indicate that the extent to which the second major party was perceived to be electorally weak at the constituency level was a significant factor in leading some Western voters to support Reform. In Quebec, however, perceptions of predominance did not matter to a vote for the Bloc because the latter is a “radical” third party attracting support mostly on the basis of communal values and interests. The results further show that political grievances, but not economic ones, were a significant predictor of support for both third parties in that election.

Résumé. Cette étude propose un nouveau test empirique de la théorie de Maurice Pinard concernant la percée électorale des tiers partis. L'impact des facteurs de Pinard (prédominance d'un parti et présence de griefs) sur l'appui au Parti réformiste et au Bloc québécois à l'élection fédérale canadienne de 1993 est vérifié au niveau micro-sociologique à l'aide des données de l'Étude sur l'élection canadienne. Les analyses de régression logistique du vote indiquent que la perception que certains électeurs de l'Ouest avaient de la faible compétitivité du second parti traditionnel dans leur circonscription les a encouragés à appuyer le Parti réformiste. Au Québec, les perceptions de prédominance n'ont cependant pas eu d'effet significatif sur le vote en faveur du Bloc en raison du fait que ce dernier est un tiers parti “ radical ” dont l'appui repose principalement sur des valeurs et des intérêts de groupe. Les résultats indiquent enfin que, contrairement aux griefs de nature économique, les griefs politiques régionaux ont significativement contribué au succès électoral des deux partis.

In this article I critically assess the globalist position which claims that the forces of globalization have fundamentally debilitated nation–states, and that the fate of progressive politics and social movements now depends on the degree and extent of international solidarity and the shaping of a transnational civil society (for example, Beck, 2000; Bronner, 1999; Brysk, 2000; Strange, 1996). Against this globalist, internationalist or cosmopolitan position, I argue that the nation–state continues to be a critical sphere for the imposition of ruling capitalist interests. Likewise, any substantial modification in the economic, political and cultural conditions of subordinate groups, communities and classes will have to be fought and won at this level. While international solidarity will always be welcome, the internationalization of politics, by itself, will not have a substantial impact on the domestic balance of forces. In fact, the main locus of politics should remain local if significant changes in the life chances of subordinate groups, communities and classes are the goal. These subordinate groups will be able to affect domestic state interventions in their favour only to the extent that they constitute themselves politically at the local level. In order to do so, their main challenge may be posited as follows: How can they extract concessions from the state without at the same time being co–opted? Facing this challenge successfully continues to require the construction of democratic organizations for struggle, an accountable leadership and grassroots participation in decision–making.

En matière de règle électorale, la recherche, d'approche « institutionaliste », s'est longtemps attardée sur les effets des différentes règles électorales sur les systèmes de partis, négligeant peut-être un peu les modes de confection et de modification de ces règles ainsi que leur usage politique.

Abstract. This article uses the recent Canadian campaign seeking redress for the infamous “Chinese head tax” as a vantage point from which to consider whether recognition-seeking social movements are undermining the cause of egalitarian redistribution. Methodologically, the article seeks to complement the normative theorizing and conceptual model-making that have tended to characterize the “recognition versus redistribution” debate by focusing more concretely on the dynamics of an actual social movement campaign. The article demonstrates how this approach can help to identify important nuances in recognition campaigns that blanket claims about recognition's impact both ignore and serve to obscure.

Résumé. Cet article étudie la récente campagne canadienne cherchant la réparation dans les cas d'application de l'infâme taxe d'immigration aux Canadiens d'origine chinoise. Cette campagne offre l'opportunité pour étudier si les mouvements sociaux militant pour la reconnaissance des situations d'abus perpétrées par le passé sont en train d'éroder la cause de la redistribution égalitaire. D'un point de vue méthodologique, l'article essaie de compléter la théoretisation normative et le developpement de modèles conceptuels qui ont seulement pris en compte le débat dit “ de la reconnaissance versus la redistribution ”, en se concentrant plus sur l'étude de la dynamique d'une campagne sociale contemporaine. L'article montre le fait que cette approche peut aider à mettre en exergue d'importants nuances dans les campagnes dites “ de la reconnaissance ”, que des études plus generaux sur l'impact de la reconnaissance ignorent.

In the last decade, the political institutions and practices under which economic decisions are made have received increasing attention in the analysis of the responsibility for economic underperformance. This attention has in turn led to a questioning of the issues of conceptualization and measurement of the variables involved. While economic variables are easily conceptualized and measured, political institutional factors present some difficulty. Although the aim of a democratic system is to assure the rights and freedoms for the citizens of a polity, for those polities in transition, the processes that drive societies towards or away from higher rights and freedoms for their citizens are more important. This paper attempts to cover the following topics: first, to construct measurable variables of democratization that can be used to determine the level of democratic development in a transition polity; and second, to apply these variables to determine the level and patterns of democratization in Nigeria. Section two highlights significant past research which has measured the levels of democracy across different countries. In section three Nigeriaxi' s political history is summarized to show a polity in continuing political transition. Section four identifies relevant dimensions of democratization in a transition polity. Section five applies the dimensions to derive indices to measure the level of democratization in Nigeria. In section six the pattern of the democratization process in Nigeria is established. Section seven justifies the measures for transition polities and suggests the use to which they may be put.

Abstract. This paper examines the existence of sub-State political cultures in Canada. In so doing it revisits research conducted by Richard Simeon and David Elkins into the existence of provincial political cultures in Canada. It reviews the evidence for provincial political cultures and examines recent data from the Canadian Election Study in an effort to determine whether attitudes towards government have changed. Second, it revisits the process by which sub-cultures are identified. Using data from the federal election profiles and the CES the paper identifies nine distinct regional variant cultures within Canada. These regional cultures possess different political attitudes and behaviours that cannot be explained by the existence of provincial boundaries.

Résumé. Cet article examine l'existence de cultures politiques sous-étatiques au Canada. Il reprend, ce faisant, les recherches de Richard Simeon et David Elkins qui démontrent la réalité des cultures politiques provinciales au Canada. L'article reconsidère l'authenticité de l'existence des cultures provinciales et étudie les données récentes de l'Étude électorale canadienne pour tenter de déterminer si les attitudes politiques ont changé. Ensuite, il réexamine le processus d'identification des sous cultures . En utilisant les profils des circonscriptions fédérales et l'ÉÉC, l'article identifie neuf variantes régionales distinctes au Canada. Ces cultures régionales manifestent des attitudes et comportement distincts qui ne peuvent pas s'expliquer par l'existence des frontières provinciales.
